These Terms and Conditions govern the use of the potandposy.com.au website “Website” and the purchase of any goods from it. The Website is owned and operated by Pot and Posy ABN 48675884755.
For the purpose of these terms and conditions, “Us”, “Our” and “We” refers to Pot and Posy and “You” and “Your” refers to you, the client, or website user.
Please note that by using the Website or ordering goods and/or services from us, the user agrees to be bound by the terms, conditions, disclaimers and limitations of liability contained in the webpages comprising the Website. You also acknowledge that you have read and understood these Terms and Conditions. We reserve the right to amend or update all information on the Website including these Terms and Conditions at any time without providing notice other than publication on the Website.
Limitation of Liability
By using the website, you agree and accept that Pot and Posy is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website. Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable.
It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
Prices & Payment
Prices of products, services and delivery on the website are current at the time of display. These prices may change without notice.
All prices are quoted in Australian dollars.
We accept payment by Visa, MasterCard, American Express and PayPal.
Orders & Delivery
For Pot and Posy to put your order through, we need some personal information from you, e.g. your name, contact details including email address and/or mobile number, billing address, delivery address and payment details.

Payment will need to be confirmed as having been received by our bank, before we can send your products.
You should receive an email confirming your order once your payment has been processed. If you don’t, there may have been a problem with processing your order. Please let us know if this happens by contacting us.
Pot and Posy offers same day delivery on all our products given the order is placed before 11am. If for some reason your order cannot be fulfilled, we will contact you via the information you have completed to discuss and rectify the situation. We may stop same day delivery for any or all of our products prior to 11am if a product is sold out or all our available delivery spots are filled.
Pot and Posy use a combination of our own couriers as well as an outsourced courier company if necessary. Our couriers create their runs based on time and efficiency.
All business deliveries will be completed between 9am- 5pm and residential deliveries between 9am-7pm. Please note we are not able to guarantee delivery at a specific time of day.
We will leave product at, or near, the door, or in another place we deem safe if there is no answer at the delivery address. Our posies are wet packed so they have a temporary water source if this occurs. If necessary, we will contact the recipient to let them know where we’ve left their flowers. If there is nowhere safe to leave the delivery we’ll call the recipient and / or you to re-arrange delivery. If re-delivery is required additional costs may be incurred and charged to you.
When your order has been delivered, you will receive an email or text message to advise you.
Should you need to cancel or change the details of your delivery please email us as soon as you can, or call. As we operate on quick turnaround times, we really need 24 hours’ notice to change or cancel an order. We will always do our best to accommodate any changes to the best of our abilities.

Products Containing Alcohol
Under NSW law, Pot and Posy gift packs containing alcohol must not be purchased by or delivered to anybody under the age of 18 years. When Pot and Posy or its couriers deliver a gift pack containing alcohol, they may ask for ID to verify that the recipient or person collecting the gift pack is 18 years or over. If they are not satisfied that this person is 18 years or over, the gift pack will not be left and a redelivery will be required – additional delivery fee may be charged.
Availability of Product
The descriptions and images of products on the website are a representation only and are not to be taken literally or compared with. Flowers in the posies featured for sale on the website may be substituted with alternative flower types depending on seasonality and availability. Images of the posies featured are an indication of the unique style and look we create at Pot and Posy.
Potted plants photos are of our stock taken in decent conditions. Variations may occur from time to time due to seasonal changes – for example plants not in flower as shown, height / size of plants, colours of plants, plants losing leaves in winter or simply growing much slower.
All natural and living products are subject to differences, environmental impacts, and no two products will ever be the same.
In the event that a product becomes unavailable, we will substitute with a similar product or variety of equal or higher value. Should this occur we may notify you prior to the order being dispatched.
Days of Operation
Pot and Posy does not operate on weekends, public holidays or over the Christmas period (unless stated otherwise on the Website) so deliveries cannot be sent on these days.
Refunds & Warranty
Pot and Posy handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.
At Pot and Posy, we pride ourselves on the quality of our products and services. It is important to remember, however, that our products are living and will react to their immediate environment and weather conditions.
Care instructions are included with every plant delivery and can also be found on the website. To increase the life span and enjoyment of your plants and posies, we strongly recommend the care instructions on the website are followed.
Pot and Posy is not responsible for lack of care once the product is delivered, such as, not placing the posy in fresh water, placing the plant outdoors in direct sunlight or a spike in temperature, however if you have any concerns please contact us so that we can help you rectify these situations if possible.
If you are dissatisfied with the lifespan or quality of your product, we require this to be communicated to us within 3 days of the delivery. Pot and Posy reserves the right to request photos or images of the original product. We require photos or may collect original product as proof so that we can review our quality processes. Regretfully, we cannot arrange a resend the product to you if the original product has been disposed of or images are unavailable.
Pot and Posy will not accept change of mind returns on any of our products.
We are unable to offer a refund if incorrect delivery information is given to us. It’s the sender’s responsibility to make sure they provide us with detailed and accurate delivery instructions. If the wrong delivery address is given we can re-deliver, but this may be at an additional cost.
Pot and Posy cannot guarantee the exact colour or variations of any flower, plant or product. All natural products are subject to differences, environmental impacts and no two products will ever be the same.
Cancellations
Should you need to cancel your order, the full amount of the order will be refunded less a $15 administrative fee, only if notice is received by Pot and Posy 24 hours prior to the scheduled delivery date. Cancellations received with less than 24 hours’ notice prior to the date of delivery will be charged at 50% of the total order value. We are unable to cancel orders that have already been created and are in the process of being delivered.
Subscription based deliveries can be postponed to another date if notified 24 hours prior to scheduled delivery date.

If you do not agree or are unable to agree with ANY of the above terms and conditions, then you must not place an order or enquire.
All discrepancies will be referenced back to the above terms on all orders, quotes, emails or any forms of communication with Pot and Posy.
